Francisco Martorell: el futuro se construye hoy

Margarita Ancacoy fue asesinada con alevosía y crueldad, su homicidio no puede quedar impune, pero la sociedad no debe tolerar que, en su nombre y sufrimiento, otros realicen prácticas que deben ser erradicadas.

La tortura es inaceptable y la forma en que una sociedad trata a sus presos define el grado de humanidad de sus habitantes. Pareciera ser que, dicho esto, los chilenos estamos al debe y bastante, porque en pocos días apareció lo peor de lo nuestro, aquello que justifica lo inaceptable y acepta lo injustificable. Como si el contexto, cambiara los principios. No, nunca, los principios son inmutables. No se adaptan ni se esconden. Porque en ellos se basa la convivencia.

Nada, ni el crimen más atroz, ni el criminal más deleznable, pierde sus derechos. Goza de la presunción de inocencia hasta que se demuestra, más allá de toda duda razonable, que es culpable. Y, una vez condenado por la justicia y no por la opinión pública, debe caer sobre él todo el peso de la ley y ser encarcelarlo por el tiempo que el juez determine. Pero no pierde sus derechos personales. Solo el de la libertad, quizá algunos cívicos, pero no los humanos.

Al preso se lo debe tratar con dignidad, porque es persona y porque eso, al llevar el principio al extremo, nos garantiza a todos que seremos tratados de igual forma si es que el infortunio o una mala decisión nos sitúa en un sitio similar. Los DDHH no tienen apellido, ni ideología ni estatus social. Y si no lo creemos así, simplemente, es porque no los valoramos. Increíble en una sociedad que vio a miles de los suyos sufrir la tortura, el exilio, la muerte y la desaparición forzada. Quizá hay que volver sobre nuestra memoria. Educación y Educación. Persistencia.

El Estado es el principal responsable de lo ocurrido. Una de sus reparticiones, Gendarmería de Chile, fue incapaz de generar las condiciones necesarias para evitar que los encausados por un delito, sujetos a una investigación y gozando de la presunción de inocencia, fueran vejados en el interior de una cárcel.
Es hora de que comencemos a entender los procesos penales, a fortalecer los principios, creer en los DDHH y deslegitimar el todo vale, la justicia por la mano propia o el ojo por ojo. Así no se construye una sociedad humana, un país de verdad y un lugar apto para vivir. Lo contrario. Crece la violencia, aumenta la inseguridad y nos insensibilizamos.

Chile tiene la obligación de crear las condiciones para que un crimen como el de Margarita no ocurra, pero también darles dignidad a sus presos y crear las condiciones carcelarias aptas para que exista rehabilitación y reinserción. El futuro se construye hoy.

However , he does not lose his personal rights – only that of freedom, perhaps some civil rights, but not human ones.

The prisoner must be treated with dignity because he is a person – and taking this principle to the extreme guarantees that we will all be treated in the same way if misfortune or a bad decision lands us in a similar place. Human Rights have no surname, no ideology nor social status. If we do not believe this to be true, it is simply because we do not value them. Incredible in a society that saw thousands of their people suffer torture, exile, death and enforced disappearance. Maybe we have to go back to our memory. Education and Education. Persistence.

The Chilean State holds the main responsibility for what has occurred. One of its departments, the Chilean Gendarmerie, was unable to generate the necessary conditions to prevent those accused of a crime, subject to an investigation and enjoying the presumption of innocence, from being harassed inside of a prison.

It is time that we begin to understand criminal proceedings, to strengthen principles, to believe in human rights and to delegitimize the “anything goes”, justice by one’s own hand or the eye for an eye. A humane society, a real country, a place fit to live in, is not built this way. Quite the opposite. By doing this, violence grows, insecurity increases, and we become desensitized.
Chile has the obligation to create the necessary conditions so that a crime like Margarita’s does not happen. Nonetheless, it is also responsible for protecting the dignity of its prisoners and create prison conditions suitable for rehabilitation and reintegration. The future is built today.
